Privacy Policy – public area (no account)
Version v1
This version applies to use without an account. As soon as you register or sign in, the full privacy policy applies; the controller is then the provider assigned to you.
1. Controller
For this website and the finder chat usable without an account, the controller is: Rainer Markussen, Heinrich-Hertz-Str. 74, 22085 Hamburg, Germany, email: ucp [at] markussen-consulting.net.
We have not appointed a data protection officer because the legal requirements for doing so are not met.
2. The open finder chat
What happens. You can use the finder chat without registering. Your input is transmitted by our server to our AI service provider OpenAI, which generates a response.
What we do not store. We do not store your chat content in our database. The conversation is kept solely in your browser's local storage and remains there until you delete it or clear your browser data. We have no access to it.
Legal basis. Art. 6(1)(b) GDPR for the use of the service you requested.
Please note: Do not enter any confidential information, trade secrets or personal data of other people into the open chat.
3. Abuse protection (IP address)
To prevent automated mass use, we limit the number of requests per minute. For this, your IP address is briefly processed in our server's memory. The application does not store the IP address permanently.
Legal basis. Art. 6(1)(f) GDPR; our legitimate interest is protecting our infrastructure from misuse as an open AI interface.
4. Anonymous usage metrics
To keep the service running and to control costs, we log technical metrics per request: the assistant used, the AI model, the number of processed text units (tokens), the response time and the timestamp. This record is kept without any personal reference – without your IP address, without an identifier and without chat content.
Legal basis. Art. 6(1)(f) GDPR; our legitimate interest is the secure operation and cost control of the service.
5. Cookies and local storage
In the public area we set no cookies. We only use your browser's local storage for the chat history and interface settings such as the language choice. This data does not leave your browser and can be deleted by you at any time via your browser settings. We do not use any analytics, advertising or tracking services.
6. Recipients of your data
- OpenAI – receives your chat messages to generate the responses.
- Vercel – operation and delivery of the website; the host's server logs may contain your IP address.
We have a data processing agreement under Art. 28 GDPR with each of these providers. Where data is transferred to countries outside the European Union, this is done on the basis of standard contractual clauses under Art. 46 GDPR; this concerns the transfer to OpenAI in the USA. Vercel processes in the EU (Frankfurt). We do not use a payment service provider.
7. Your rights
You have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21 GDPR).
To exercise them, please use our contact form (the "Contact" link in the footer).
Independently of this, you may lodge a complaint with a data protection supervisory authority, for example the one responsible for us: Der Hamburgische Beauftragte für Datenschutz und Informationsfreiheit, Ludwig-Erhard-Str. 22, 20459 Hamburg, Germany.
8. Changes to this privacy policy
We adjust this policy when the service or the legal situation changes. The version published on this page applies. The German version is authoritative.
